1. About These Terms
These Terms & Conditions (“Terms”) govern your use of the OceanMinded website at www.oceanminded.eu and the purchase of any services or digital products offered through it. By accessing the website or making a booking, you agree to these Terms in full.
OceanMinded is operated by Markus Mutter, based in 11159 Los Caños de Meca, Cádiz, Spain, Andalusia, Spain, with programmes also delivered in Lanzarote, Canary Islands and Germany.
If you do not agree with any part of these Terms, please do not use this website or purchase our services.
2. Our Services
OceanMinded offers the following services and products:
- Freediving coaching and training (pool, open-water, and courses)
- Breathwork & Nervous System coaching (1:1, group, online, and in-person)
- Retreats (freediving, breathwork, and mixed programmes)
- Digital products (workbooks, recorded courses, downloads, and audio content)
- Blog content and informational resources
Services are available to the general public, corporate clients, and sports environments.
Some OceanMinded digital products, including the Functional Breathwork for Children audiobook, are designed for use by or with children and young people. These products are intended to be purchased and overseen by a parent, guardian, or educator. OceanMinded does not accept direct purchases or registrations from individuals under the age of 16 without verifiable parental or guardian consent.
In-person coaching, group sessions, and live online services remain subject to the separate age and health requirements set out in Section 5. OceanMinded does not provide unsupervised live instruction to children under the age of 16, and any participation by a minor in a live session requires prior written consent from a parent or legal guardian.
3. Bookings & Payments
All bookings are subject to availability and are confirmed only upon receipt of full payment or a clearly stated deposit. Prices are displayed on the website and are inclusive of any applicable taxes unless stated otherwise.
We accept payment via the methods listed at checkout. Any bank or payment processing fees are the responsibility of the client and may be deducted from any refunded amounts.
4. Refund & Cancellation Policy
Our full Refund & Cancellation Policy forms part of these Terms and applies to all services. Please read carefully before booking.
4.1 Freediving Coaching & Training
Your place is confirmed once full payment or deposit is received. Remaining balances are due no later than 7 days before the course date. One free reschedule is available per booking if requested more than 7 days in advance.

4.2 Breathwork & Nervous System Coaching

Packages & Programmes: Non-refundable once commenced. If you need to pause or discontinue for health or personal reasons, please contact us — we handle these situations individually and with care.
Online Workshops & Live Group Sessions:

4.3 Retreats
A non-refundable deposit (typically 30–50% of the retreat fee, as stated at booking) is required to secure your place. The remaining balance is due 30 days before the retreat start date.

You may transfer your place to another person, provided you notify us in writing at least 14 days before the retreat and the replacement participant completes all required health and liability forms.
4.4 Digital Products
All sales of digital products (workbooks, recorded courses, audiobooks, and downloads) are final once the product has been accessed or downloaded. This includes the Functional Breathwork for Children audiobook and any other audio content. Responsibility for appropriate use of children’s content rests with the purchasing adult.
If you experience a technical issue preventing access, please contact us and we will resolve it promptly.
4.5 Cancellations by OceanMinded
If OceanMinded must cancel any service (e.g. due to instructor illness, force majeure, or insufficient bookings), you will receive a full refund of all amounts paid, or the option to reschedule. OceanMinded is not liable for any additional costs you may have incurred, such as travel or accommodation.
4.6 EU Statutory Right of Withdrawal
For online bookings made by private consumers within the EU, you may have a statutory 14-day right of withdrawal under EU consumer law. However, by booking and agreeing to commence a service or access a digital product before this period expires, you acknowledge that this right is waived upon commencement. Full details will be provided at the point of booking.
5. Health, Safety & Participant Responsibility
Freediving and breathwork activities carry inherent risks. By booking any in-person or online session, you confirm that:
- You are in good physical and mental health and fit to participate.
- You have disclosed any relevant medical conditions, injuries, or contraindications prior to participation.
- You will follow all safety instructions provided by OceanMinded instructors at all times.
- You accept personal responsibility for your participation and understand that OceanMinded cannot be held liable for injury, illness, or loss arising from your failure to disclose relevant health information or to follow safety guidelines.
OceanMinded reserves the right to refuse participation to any individual whose health or behaviour poses a risk to themselves or others, without obligation to refund.
Where a parent or guardian purchases digital content such as the Functional Breathwork for Children audiobook and facilitates its use with a child, OceanMinded is not present during that use and accepts no liability for how the material is applied in that context. The purchasing adult assumes full responsibility for supervising and adapting the content appropriately for the child in their care.
6. Intellectual Property
All content on this website, including text, images, videos, course materials, audiobooks, and programme content, is the intellectual property of OceanMinded (Markus Mutter) unless otherwise stated. You may not reproduce, distribute, or use any content for commercial purposes without prior written permission.
7. Limitation of Liability
To the fullest extent permitted by applicable law, OceanMinded shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of this website or participation in our services. Our total liability to you shall not exceed the amount you paid for the specific service giving rise to the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
8. User-Generated Content
OceanMinded does not currently offer user accounts or user-generated content features. Should this change in the future, these Terms will be updated accordingly and you will be notified.
9. Third-Party Links
Our website may contain links to third-party websites. These are provided for convenience only. OceanMinded has no control over and accepts no responsibility for the content or practices of any third-party sites.
10. Governing Law & Disputes
These Terms are governed by the laws of Spain. Any disputes arising from these Terms or your use of our services shall be subject to the jurisdiction of the courts of Andalusia, Spain, unless mandatory consumer protection laws in your country of residence provide otherwise.

11. Changes to These Terms
We may update these Terms from time to time. Continued use of the website or services after any changes constitutes acceptance of the updated Terms. The date at the top of this page reflects the most recent version.
